A law firm website is lawyer advertising under Rule 4-7.11 of the Rules Regulating The Florida Bar. Here is what we watch for when we build yours.
- Your website does not need to be filed
- Lawyer and law firm websites are exempt from the Bar's 20-day advertising filing requirement under Rule 4-7.20(g), including pop-ups on your own site. The content rules still apply, so the rest of this list does too.
- Firm name and office location on every page
- Rule 4-7.12(a) requires the name of at least one lawyer or the firm, and the city, town, or county of a bona fide office. Your site footer carries both on every page.
- No predictions or guarantees
- Rule 4-7.13(b)(1) bars statements a prospective client could read as a prediction or guarantee of results. We write about your experience and how you work, and avoid promises about outcomes.
- Past results only when verifiable
- Rule 4-7.13(b)(2) allows past results only when they are objectively verifiable, and the Bar's comment calls for the client's informed consent. We leave case results off unless you supply them and confirm both.
- Testimonials carry the required disclaimer
- Rule 4-7.13(b)(9) allows a testimonial only when it is the client's actual experience, in the client's own words, uncompensated, and shown with the disclaimer that a prospective client may not obtain the same or similar results. Wherever a review appears on your site, that disclaimer appears with it, clear and conspicuous as the 2022 amendments require.
- Specialist and expert claims
- Rule 4-7.14(a) limits the words specialist, expert, and board certified to lawyers certified under the Florida Certification Plan or an accredited plan, or who can objectively verify the claim. We say what you practice and leave those words out unless you are certified.
